By accessing or using the ElderMoor website (the "Site"), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must discontinue use of the Site immediately. ElderMoor reserves the right to update or modify these terms at any time without prior notice. Continued use of the Site after changes constitutes acceptance of the new terms.

You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use and enjoyment of the Site. Prohibited activities include, but are not limited to, uploading malicious software, attempting to gain unauthorized access to our systems, or engaging in any form of data scraping.

2. Limitation of Liability

ElderMoor provides all products and content on the Site "as is" and "as available" without any warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. To the fullest extent permitted by applicable law, ElderMoor shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products, including but not limited to loss of profits, data, or business interruption.

Our total liability for any claim arising from these terms or your use of the Site shall not exceed the total amount paid by you for the product giving rise to the claim. This limitation applies regardless of the legal theory under which the claim is brought, whether in contract, tort, or otherwise.

3. Intellectual Property Rights

All content on the Site, including text, graphics, logos, images, product designs, and software, is the exclusive property of ElderMoor or its licensors and is protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content without prior written consent from ElderMoor.

The ElderMoor name, logo, and all related product names and designs are trademarks of ElderMoor. Unauthorized use of these trademarks is strictly prohibited. Any feedback, suggestions, or ideas you submit to us become our intellectual property, and you waive any rights to compensation for such submissions.

4. Refund Policy

ElderMoor is committed to your satisfaction. If you are not completely satisfied with your purchase of T-Shirts & Tops, Shorts, or Skirts, you may request a refund within 30 days of the delivery date, subject to the following conditions:

Items must be unworn, unwashed, and in their original condition with all tags attached.
Refunds are processed to the original payment method within 5-10 business days after we receive and inspect the returned item.
Shipping costs for returns are the responsibility of the customer, unless the item is defective or incorrect.
To initiate a refund, please contact us at support@eldermoor.com with your order number and reason for return.
ElderMoor reserves the right to refuse refunds for items that show signs of wear, damage, or misuse.

For defective or incorrectly shipped items, we will provide a full refund including original shipping costs, or offer a replacement at no additional charge. Please report any issues within 7 days of delivery.

5. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts located in Delaware.
